Our premises is very large. We are on a corner stand in Durban North (Longwoods Drive and 195 Umhlanga Rocks Drive), and have entrances as well as parking areas inside the property on both sides.
Accommodation.
Sleeping accommodation for up to 26 people inside our lodge consists of a variety of units, including sleep over only, bed-and-breakfast as well as self catering units.
Events.
We have an inside hall (about 17m x 6m) with an inbuilt bar, which opens out onto a slasto floor at the front of the lodge.
At the back of the lodge is an outside deck area. This can seat about 20 people and is adjacent to a kitchenette. The deck overlooks the terraced garden and swimming pool, and has stunning inland views.
The swimming pool and can host kiddies or adult pool parties.
The venues can be booked for a morning afternoon or evening event:
Self catering functions at a cost of R1500 for up to 30, R2000 up to 50, R2500 up to 80, R3000 up to 100 including:
parking;
tables, chairs, linen.
Extra R500 for cultery and crockery.
We can provided catered functions at between R120 and R180 per head depending on the menu.
Light meals eg. quiches,salads and baked desserts
Substantial meals including spitbraais, including entre, main and desserts.
Functions include weddings, Bridal Showers, Baby showers, Pool parties, kiddies parties... etc.

GENERAL TERMS, CONDITIONS AND ACCOMMODATION CONTRACT OF DURBAN ACCOMMODATIONAS AT 01-07-2011 (updated 01 09 2018)
1) SCOPE & OTHERS
(i) These General Terms and Conditions apply for Accommodation Contract as well as all other services and facilities rendered to the Guests by DURBAN ACCOMMODATION.
(ii) Deviating from the booking requirements , also to the extent included in the General Terms and Conditions by the Guest or the representative Third Party, shall not apply unless expressly approved by DURBAN ACCOMMODATION writing.
(iii) DURBAN ACCOMMODATION is a B & B offering Accommodation, Conference and Wedding Facilities.
(iv) To secure a booking 50% of the total rate is required within 48 hours of making a reservation, either by EFT or IB into our bank account. The balance is payable on arrival either in Cash, Visa/+-MasterCard. All Bank details are written on our quotes and invoices.
(v) Regretfully, NO cheque will be accepted for payment, under any circumstances.
(vi) After initial check in, and keys have been handed over – guests keep whatever hours they choose to.
(vii) Once the transfer/deposit has been made we require that you send DURBAN ACCOMMODATION proof of payment together with the signed page of the General Terms, Conditions and Accommodation Contract in order that we can provide a speedy confirmation of your booking requirements.
2) CONCLUSION OF THE CONTRACT
(i) Upon the Guest’s request for a reservation, an accommodation contract is brought about by DURBAN ACCOMMODATION’s corresponding confirmation of the reservation (hereinafter referred to as “The Contract”)
(ii) Contractual partners are DURBAN ACCOMMODATION and the Guest. If a third party has made the reservation on behalf of the Guest, this third party shall be liable vis-à-vis with DURBAN ACCOMMODATION jointly and severally with the Guest for all obligations resulting from the Contract if DURBAN ACCOMMODATION is in possession of a corresponding declaration given by the Third Party. Independent therefrom, any Third Party is obliged to pass on all booking related information to the Guest(s), in particular the present General Terms and Conditions.
(iii) Sub- and re-leasing of rooms as well as their usage for purposes other than accommodation require the prior written consent of DURBAN ACCOMMODATION.
(iv) Bookings can only be done by contractually capable people.
3) PRICES & PAYMENT
(i) DURBAN ACCOMMODATION is obliged to have the booked room(s) or self-catering unit(s) available according to the present General Terms, Conditions and Accommodation Contract plus the Invoice to fulfill the services agreed.
(ii) In the event of any unforeseen circumstances beyond the control of DURBAN ACCOMMODATION will be fully entitled to accommodate the Guest(s) in another lodge with comparable standard and service for the price agreed without recourse.
(iii) The Guest is obliged to pay the prices applying to or agreed on for the provision of accommodation and additional services he / she has negotiated and booked. This also applies to services and expenses of DURBAN ACCOMMODATION vis-à-vis third parties incurred for performances rendered upon the Guest’s request.
(iv) The prices may also be changed by DURBAN ACCOMMODATION if the Guest subsequently wants to change the number of the booked rooms, the facilities offered by DURBAN ACCOMMODATION or the duration of the Guests’ stay and DURBAN ACCOMMODATION gives its consent thereto.
(v) Upon receipt, the invoice (s) issued by DURBAN ACCOMMODATION shall become payable immediately or within 48 hours or within a period as agreed with Management, without deduction. In the case of default of payment, within the stipulated/agreed time frame, DURBAN ACCOMMODATION may charge a reminder fee of ZAR5.00.
(vi) As there will be no refund for cancellation for whatever reason upon arrival of Guest(s) at DURBAN ACCOMMODATION we strongly recommend that a potential guest nominate a family member or third party representative to visit DURBAN ACCOMMODATION or look at the website pictures and details on www.durban-accommodation.com to ensure that the accommodation /or facilities are up to the Guests’ required standards.
4. REVOCATION BY THE GUEST - (CANCELLATION, FAILURE TO TAKE ADVANTAGE OF SERVICES BOOKED)
(i) DURBAN ACCOMMODATION grants to the Guest the right to revoke the Contract at any time.
In this respect, the following provisions shall apply:
1.Bookings for groups or individuals: cancellations made by the guest respectively on the part of the intermediary person or organization are free of charge up to 90 days before expected arrival. For cancellations made within 90 days prior to arrival the following cancellation fees apply; these fees also apply for bookings made within 90 days of expected arrival:
1. For Cancellations made 89 to 40 days before expected arrival, 30 per cent of the agreed-upon total price will be due.
2. For cancellations made 39 to 10 days before expected arrival, 50 per cent of the agreed-upon total price will be due
3. For cancellations made 9 to 1 day(s) before expected arrival, 100 per cent of the agreed-upon total price will be due.
4. Guests who either cancel on the day of their expected arrival or simply do not show up will be charged the agreed-upon total price in full.
5. Above cancellation conditions also apply if the number of persons is reduced at least 10 per cent within this period of time. A reduction of less than 10 per cent is free of charge 1 day prior to arrival.
6. Guests are entitled to postpone the booking to a later date giving no less than 21 working days notice. No fee will be charged in the event of a postponement, the deposit will not be refunded but carried forward to the later booking date. However if during the interim the DURBAN ACCOMMODATION has posted price increases for the accommodation /facilities then the Guest will be required to pay the new prices in effect at confirmation of the new reservation date.
2. Booked conference lunches can be cancelled free of charge until 7 days prior to arrival. Thereafter, a cancellation fee of 100 per cent of the agreed-upon total price applies.
(i)The Guest is free to prove that DURBAN ACCOMMODATION did not suffer any damage, or that the damage incurred to DURBAN ACCOMMODATION amounts to less than the lump-sum revocation compensation claimed.
(ii)The above provisions on the compensation shall apply if no other regulations have been declared in the Contract.
(iii) If a customer wishes to cancel a contract he or she entered into with Durban Self Catering, he or she must submit such cancellation in writing. The cancellation is not, however, valid without the written affirmation of DURBAN ACCOMMODATION. Failing that, the original price stipulated in the contract or invoice must be paid in full even if the guest(s) fail(s) to take advantage of the facilities stipulated in the contract.
5. REVOCATION BY DURBAN ACCOMMODATION
(i) In case an advance deposit payment agreed in clause 3 paragraph (v) is not performed within a period prescribed for this purpose, DURBAN ACCOMMODATION is also entitled to revoke the Contract.
(ii) Moreover, DURBAN ACCOMMODATION shall be entitled to extraordinary revocation of the Contract for good cause, in particular, if:
1. Force majeure or other circumstances which do not fall under the scope of the responsibility of DURBAN ACCOMMODTION make it impossible to perform the Contract;
2. Misleading or incorrect statements of material facts have been used in booking rooms, for example, with respect to the person of the Guest(s), or the purpose of use;
3. DURBAN ACCOMMODATION has justified reason to assume that in case the Guest makes use of DURBAN ACCOMMODATION’S services the smooth business operations, safety, or reputation of DURBAN ACCOMMODATION in the public may be impeded, without such matters being attributable to DURBAN ACCOMMODATION’S power of control or organization;
4. An unauthorized sub-lease or further lease according to clause 2 paragraph (iii) exists;
5. A case of clause 6 paragraph (iii) exists;
(iii) DURBAN ACCOMMODATION is obliged to inform the Guest of the exercising of the revocation right in writing without delay.
(iv) In the above cases of revocation the Guest is not entitled to compensation for damage.
6.ARRIVAL AND DEPARTURE
(i) The Guest is not entitled to the provision of certain specific rooms unless Durban Accommodation has confirmed the provision of certain rooms in writing. For groups of 10 or more, DURBAN ACCOMMODATION retains the right to determine the type of accommodation provided (i.e. to determine the allocation of singles, doubles and multi-bed rooms). DURBAN ACCOMMODATION will, however, take the guest requests into consideration and do its best to grant them where possible. The exact apportionment of rooms will be provided in the booking confirmation.
(ii) Booked rooms shall be at the Guest’s disposal from 11.00 am on the agreed date of arrival. The Guest shall not be entitled to an earlier provision.
(iii) Booked rooms shall be taken by the Guest(s) on the agreed date of arrival by 7.00 pm at the latest. Unless a later time of arrival has been guaranteed by credit card or prepayment, DURBAN ACCOMMODATION has the right to place the booked rooms with other guests after 7.00 pm, without the contractual party being able to claim any compensation as a result thereof. In so far, DURBAN ACCOMMODATION is entitled to revocation.
(iv) On the agreed date of departure, the rooms shall be vacated and at DURBAN ACCOMMODATION’s free disposal by 10:15 am at the latest. Thereafter, DURBAN ACCOMMODATION may charge, beyond the damage incurred to it thereby, 70 per cent of the daily room rate for the additional use of the room until 6.00 pm, and from 7.00 pm 100 per cent of the full applicable price for lodging. The Guest is free to prove vis-à-vis DURBAN ACCOMMODATION that no damage or a considerable lower damage has been incurred to DURBAN ACCOMMODATION.
(v) For groups of 10 or more, DURBAN ACCOMMODATION must be provided with a list of the full names of all group members no later than upon arrival. This helps to identify items left behind in a room which need to be returned to the rightful owners.
(vi) If the actual number of guests exceeds the number booked and expected, accommodation is not guaranteed for these additional group members.
7. OTHER REGULATIONS AND TERMS
(i)Adherence to the most up-to-date version of the House Rules is stipulated in this contract. These can be requested at DURBAN ACCOMMODATION reception. Groups of 10 or more must read and sign a copy of these House Rules at the latest upon arrival.
(ii) Persons under the age of 17 are not allowed to sleep alone and have to be accompanied by an adult or unless an agreed letter of responsibility is written by a legal guardian.
(iii) When both accommodation and breakfast have been booked, breakfast will be served on the morning following each overnight stay. Unless otherwise arranged beforehand breakfast will be served starting 7:15am and the dining room will be closed at 9:15am. The start time of breakfast is flexible and can be negotiated with Management on or before arrival.
8. LIABILITY OF THE ESTABLISHMENT, LIMITATION
(i) The guest is liable for all inventory losses and damages caused by misuse, carelessness or negligence. Should the guilty individual not come forward or be discovered, the group as a whole will be held liable.
(ii) If any interference with the performance of any obligation or if defects in the service of DURBAN ACCOMMODATION occur, DURBAN ACCOMMODTION will, on immediate complaint of the guest, endeavor to remedy the same. If the Guest fails culpably to notify a defect to DURBAN ACCOMMODATION , this shall not result in a right to reduce the contractually agreed remuneration.
(iii)DURBAN ACCOMMODATION is not liable for any damage arising from the injury to life and limb. Nor is DURBAN ACCOMMODATION liable for theft of any possessions belonging to a guest.
(iv) The Guest is provided with a free parking space in the car-park of DURBAN ACCOMMODATION, restricted to cars , LDV’s, trailers and boats only due to gate entrance height restrictions. DURBAN ACCOMMODATION shall not have any surveillance obligations for the vehicles. If vehicles or the contents of the vehicles parked or otherwise situated on
DURBAN ACCOMMODATION premises are lost or damaged, DURBAN ACCOMMODATION shall be not be liable unless DURBAN ACCOMMODATION, its legal representatives or it’s vicarious agents have caused such damage by willful intent or gross negligence and in the event of any such instance, the person having caused the damage was witnessed at the time and can be identified by a DURBAN ACCOMMODATION staff member. In this case, the damage must be claimed vis-à-vis DURBAN ACCOMMODATION on departure from DURBAN ACCOMMODATION at the latest.
(v) The Guest’s claims for damages shall fall under the statute of limitations two years at the latest from the time the Guest obtains knowledge of the damage, or, irrespective of this knowledge, three years at the latest after the damaging event.
This shall not apply to the liability for damages arising from the injury to life or limb as well as for any other damage based on a breach of duty through willful intent or gross negligence on the part of ACCOMMODATION , a legal representative or a vicarious agent of DURBAN ACCOMMODATION.
9. GENERAL
All guests have free access to the grounds, braai facilities, and swimming pool.
Swimming is at the Guests own risk and DURBAN ACCOMMODATION is not responsible for any accidents that may occur when using the pool facility
No gas stoves , gas braais or fires are permitted indoors
DURBAN ACCOMMODATION will not be held responsible for any contraband or narcotics brought onto the property the guest(s) does so at its’ own peril and responsibility
Free WiFi in the rooms
Free limited tv channels in every room and self catering units
10. FINAL PROVISIONS
There will be no changes or amendments to the Contract, once acceptance of the offer has been made and the General Terms and Conditions and Accommodation Contract signed. Any unilateral changes or modification on the part of the Guest made by the Guest shall be invalid.
Place of performance and payment shall be the registered office of the Establishment.
Exclusive place of jurisdiction in the business transactions – also in the case of bills of exchange – shall be the registered office of DURBAN ACCOMMODATION located at 195 Umhlanga rocks Drive, Durban North, KZN postal code 4051. However, DURBAN ACCOMMODATION is also entitled to institute complaints and other legal proceedings at the general place of jurisdiction of the Guest.
For bookings in South Africa, South African law applies. The Uniform law on the International Sale of Goods and the Conflicts of Law do not apply and may not be applied.
Should individual provisions of these General Terms and Conditions for the Establishment Accommodation or Facility Contract be or become invalid or void, the validity of the remaining provisions shall not be affected thereby. Moreover the statutory provisions shall apply.
