Emergency Executive Order No. 2.5, signed January 30, 2026, continues New York City’s ongoing state of emergency—first declared in October 2022—used to support Humanitarian Emergency Response and Relief Centers that provide temporary housing amid increased arrivals in recent years. The order extends the emergency for 30 days, briefly extends provisions from Emergency Executive Order 2.4 for an additional five days, and—crucially—requires a concrete exit strategy: by February 19, 2026, the NYC Department of Social Services and the NYC Department of Homeless Services (working with the NYC Law Department) must deliver to the Mayor a plan to phase out facilities that are still operating under emergency suspensions and modifications of laws and rules.

What the order does (key points)
Extends the overall State of Emergency for 30 days (originally declared October 7, 2022 under Emergency Executive Order No. 224).
Extends Section 1 of Emergency Executive Order 2.4 (Jan. 25, 2026) for 5 days.
Sets a hard deadline: Feb. 19, 2026 for DSS/DHS to submit a phase-out plan for facilities relying on continued legal/rule suspensions.
Takes effect immediately and notes the emergency can be extended again in additional 30-day increments if needed.

Emergency Executive Order No. 2.5
WHEREAS, pursuant to a state of emergency first declared by Emergency Executive Order No. 224, dated October 7, 2022, and subsequent orders extending such state of emergency, the City has operated Humanitarian Emergency Response and Relief Centers to provide temporary housing in response to the substantial increase in arrivals during recent years; and

WHEREAS, such orders issued prior to January 5, 2026 did not provide or require a plan for actions that would be taken to eliminate the need for the suspensions and modifications of laws and rules effected by the orders; and

WHEREAS, such state of emergency continues for the present pending the expedited development and implementation of such plan;

NOW, THEREFORE, pursuant to the powers vested in me as Mayor of the City of New York, by the laws of the State of New York and the City of New York, including but not limited to the New York Executive Law, the New York City Charter and the Administrative Code of the City of New York, and the common law authority to protect the public in the event of an emergency:

Section 1. I hereby direct that the State of Emergency declared in Emergency Executive Order No. 224, dated October 7, 2022, and extended by subsequent orders, is extended for thirty (30) days.

§ 2. Section 1 of Emergency Executive Order No. 2.4, dated January 25, 2026, is hereby extended for five (5) days.

§ 3. By no later than February 19, 2026, the Department of Social Services and the Department of Homeless Services, in consultation with the Law Department, shall develop and submit to the Mayor a plan to phase out the continued use of facilities that have been operated in reliance on the suspensions and modifications of laws and rules.

§ 4. This Emergency Executive Order shall take effect immediately. The State of Emergency shall remain in effect for a period not to exceed thirty (30) days or until rescinded, whichever occurs first. Additional declarations to extend the State of Emergency for additional periods not to exceed thirty (30) days shall be issued if needed.

New York Gov. Kathy Hochul ordered state buildings to fly flags at half-staff from sunrise to sunset on Tuesday, Oct. 7, and directed landmarks—including One World Trade Center, the Mario M. Cuomo and Kosciuszko bridges, Empire State Plaza, Niagara Falls, Grand Central Terminal’s Pershing Square Viaduct, and Moynihan Train Hall—to be illuminated yellow in solidarity with Israel and the 48 remaining hostages. Governor Kathy Hochul today directed flags on State buildings to be flown at half-staff from sunrise to sunset on Tuesday, October 7 in remembrance of the victims of the Hamas attack on Israel two years ago. Additionally, the Governor directed landmarks to be illuminated in yellow in solidarity with Israel and the 48 remaining hostages who have not been returned home.
“Two years after the horrific attack on the people of Israel, we stand with Jewish people in New York and around the world today and every day, and remember the victims of that tragic day and those still held hostage today,” Governor Hochul said. “As the home of the largest Jewish population outside of Israel, we mourn this tragedy and continue to pray for the safe return of the remaining hostages, an end to the war, and a lasting peace.”

Earlier this week, the holiest day of the Jewish calendar was marred by a horrific act of antisemitic violence in Manchester, England. Out of an abundance of caution, Governor Hochul directed New York State Police to increase patrols at religious sites and initiate outreach to Jewish communities statewide. Heightened uniformed patrols remain in place this week, and the state Counter Terrorism Intelligence Unit (CTIU) and special operations teams will be fully engaged.
