Jim gave me permission to do this. Jim got hit by a logging truck about 6 years ago. Was in a coma for about 4 months, could not walk at all when he woke. He was sent home and had to crawl to get food as his wife was out with someone else. His attorney asked for our help. Got him PT, disability, nursing care and then invested his funds from the lawsuit, sent him to a special school that taught him to drive again after working with Toyota to design a car he can drive without using his bad leg, bought a house for him in Pennsylvania where he was from originally, close to his mother. He visited today while visiting his daughter, he and I are very tight and we speak often.

He walks, with a limb as his left leg does not work and one eye bad.

I won the Supreme Court decision today. I am so emotional about this I can't even speak right. I want to thank the few people that supported me in this matter for the last 4/5 years, the win in lower court, the loss in Appeals Court, and now the win in Sureme Court.

Here is what my attorneys sent me about 20 minutes ago:

Stephen,

Congratulations--you are back open for business!

The Supreme Court has reversed the Court of Appeals' decision, and it directly held that your companies are not engaged in "trust business." A copy of the decision is attached. The agency will have 15 days to seek reconsideration, but this opinion is unanimous, making it highly unlikely that any reconsideration request would stick.

You may want to go ahead and circulate this to the judges who have been following the situation, but this opinion will be published in the Supreme Court's weekly report that comes out every Wednesday morning, so word will get out soon enough.

You are to be commended for sticking this out. Most people cower when the government comes calling, but you did your own clients a great service by staying in the fight. (And, personally, I'm thrilled to see Jim and Molly's great work get vindicated after the Court of Appeals fumbled the ball.)

Congratulations again!

Todd

Went to a HS yesterday and met a student whose mother passed away this past year. She lived with her mother and brother in state housing. The brother had to start work, get lease in his name and take over from his mother to care for his sister, again she is in HS. She has been accepted into CCU, but the funds were not there. We developed a scholarship for her, with the help of Mickey Beach and a guidance counselor at her school who came up with all associated fees etc. to cover her expenses.

Out of all the funds we give to schools, poor, elderly, church’s that help others, county programs, sports for these kids, scholarships, etc. this young lady deserves a foot up.

Wish we could help others but just maybe if we help one person, later on in her years maybe she will help two others.

Please note no names of school or recipient.

Presented to a handful of senators last week what we do to help people with less than $50 million dollars, whereby large institutional banks won’t take these clients on to help manage their personal affairs.
Special committee was setup to evaluate how best to help others that large institutions won’t take on or can’t provide support to or for.
We may yet get to change the way companies like mine get to help people.
Banking commission now going after several other companies and law firms that they feel are competing with major banks such as Wells Fargo, BOA, and alike.

We are far too familiar with the suffering of others, the sacrifice we give to help others, which is why we need to stay in the fight and do what we can to help others.

We were invited to the Sharks girls Softball opening game at St. James High School to throw out the first ball by their coach Paula. The girls welcomed us, every single one of them were well mannered and spoke to us. Video of our Maddie throwing out the ball. We were also presented with a plaque that will be hung in their press box. Honoring a trust that helps kids at schools.

I looked at these girls and saw how each one is learning to be not only a team player, but learning a skill that many will take into their adult life, highly driven.

Government Oversight- Several years ago the Banking Commission of SC initiated legal action against our company to have it report to them and not separate Probate Courts throughout the state, saying companies doing business as Guardian, Conservator, POA, and Estate Representative have to get authorized through them. Action was brought to the SC Court in Georgetown, we won. The decision was appealed and was heard by a three member Appeals Court and we lost. We appealed to SC Supreme Court. Two weeks ago, the Supreme Court agreed to hear our case. This in itself is historic.
We try to protect others and help them at the worse time of their lives. Many see this action against us as a negative, but most attorneys see this as us fighting for the rights of others, and agree jurisdiction should be left to county courts. Additionally they look up to us for fighting the battle that most were afraid to fight. I received over 100 phone calls when this stated from other companies who said they do the same, I asked if they wanted to participate in the legal action, all asked that they not be identified, this declined. Any attorney who does not see fighting this battle is worthy, then they themselves need to look at why they are doing this work and don’t really care about their clients.
This will impact every state in the united state.

We have 5 cases with the Office of the South Carolina Attorney General Vulnerable Adults & Fraud Unit. These are people who have used funds for their own use rather than the vulnerable adult, all but one are family members who stole their funds.
