2022 College Football Tailgate Tour Helmets Giveaway
OFFICIAL RULES
1. The 2022 College Football Tailgate Tour Helmets Giveaway (the “Promotion”) is offered and sponsored by FishBait Solutions, 1968 Long Creek Rd, Wadmalaw Island, SC 29487 and R&R Bait & Tackle, LLC, a Tennessee limited liability company, with offices located at 6030 Keats St. Unit # 104, Franklin, Tennessee 37604 (collectively, the “Organizer”). Sweepstakes entry period begins on August 27, 2022 and ends on January, 7 2023 (the “Entry Period”). During the Entry Period, one (1) grand prize will be awarded per team on the 2022 College Football Tailgate Tour, forty-one (41) total prizes awarded during the Promotion. To be eligible for the prizes, entries must be received as outlined in these Official Rules (the “Rules”). Any person submitting an entry form (an “Entrant”) agrees to be bound by these Rules and all decisions of the Organizer and the 2022 College Football Tailgate Tour. The Organizer, 2022 College Football Tailgate Tour, and any of their subsidiaries, officers, directors, employees, clients and agents, including without limitation their advertising and promotion agencies shall be referred to, collectively, as the “Promotion Entities.”
2. Eligibility. No purchase or payment is necessary to enter or win. A purchase will not increase the chance of winning. An Entrant must be a legal resident of the 50 United States and the District of Columbia. An Entrant must be 21 years of age or older at time of entry. Employees of the Promotion Entities and members of the immediate families, (biological, step, or in-law) including parent, grandparent, child, sibling or spouse of any of the foregoing (regardless of where they live) or households of any of the above, whether related or not, are not eligible to participate or win a prize. The Promotion shall be void where prohibited by law.
3. How to Enter. An Entrant may participate in the Promotion during the Entry Period by posting a photo with a helmet of a team competing in the 2022 College Football Tailgate Tour to either Facebook or Twitter and expressly including and mentioning the 2022 College Football Tailgate Tour by using the official hashtag, , in the photo description or in the tweet (an “Entry” or, collectively, the “Entries”). No other methods of entry will be accepted. Organizer reserves the right to disqualify any Entries determined to be tampering with or abusing any aspect of the promotion. There shall be a limit of one (1) Entry per person. By submitting an Entry in the Promotion, Entrant agrees that the Promotion Entities may provide Entrant with promotional materials using the contact information provided on social media.
4. Selection of Winner. Organizer will select one grand prize winner per team on the 2022 College Football Tailgate Tour. On Friday, January 7, 2023 at 10:00 a.m. ET, Organizer will select winners at random from the valid Entries (each, a “Selected Entrant”). By entering, Entrant agrees that the Promotion Entities are not responsible for any disciplinary action, suspension, probation, or any other punishment taken by any university or sports association for any conduct or behavior related to this Promotion. Selected Entrants will be contacted by the Promotion Entities via Facebook or Twitter by, specifically, a comment or reply to the Entry and, if possible, a direct message to the Entrant via Facebook or Twitter. Upon notification, Selected Entrants must provide proof of identity and their mailing address. Organizer’s decisions are final and binding. There is a limit of one (1) prize per person/household. Each Selected Entrant will be notified within approximately twenty four (24) hours after being selected via the contact method described above. If a Selected Entrant fails to respond or otherwise communicate with Organizer within the time periods provided in these Rules (including providing Organizer with phone, address, e-mail or other contact information after Organizer notifies the Selected Entrant of the outcome of the Promotion), if he/she is found to be ineligible, if he/she cannot or does not comply with these Rules, and/or if his/her prize is returned as undeliverable, such Selected Entrant will be disqualified, and an alternate winner may be selected (at Organizer’s sole discretion) from the remaining qualified eligible Entries received. A Selected Entrant must comply with all terms and conditions of these Rules, and winning is contingent upon fulfilling all requirements stated herein. A Selected Entrant is not an official and confirmed winner until he/she has completed, signed and returned all required documentation, including, but not limited to, a liability release and affidavit of eligibility, and except where prohibited, a publicity release, and the eligibility of the Selected Entrant has been verified. All such forms must be received by Organizer within two (2) business days after being sent to the Selected Entrant. If a Selected Entrant does not complete and return all forms necessary within the time given, he/she will forfeit the prize and an alternate winner may be chosen at Organizer’s discretion. Promotion Entities are not responsible for documents not received within the required timeframe. All decisions of the Promotion Entities and/or their designees shall be binding and final.
5. As stated above, there will be one (1) grand prize per team on the 2022 College Football Tailgate Tour awarded on January 7, 2023. Entries must be received during the Entry Period to be eligible for the prizes. Each grand prize will consist of one team helmet per school on 2022 College Football Tailgate Tour for a total of 41 winners. All other expenses not specifically mentioned herein are solely the responsibility of the grand prize winners. Other restrictions may apply. The Promotion Entities assume no responsibility for lost, stolen or damaged prizes. Estimated retail value per prize package is up to $1,000. If the prize is refused or the winner selected is not eligible, it will be forfeited and may be awarded to an alternate. No more than the number of prizes advertised herein will be awarded. PLEASE NOTE: The ARV on prizing is based on US dollars.
6. Odds of Winning. Odds of winning are dependent upon the number of Entries.
7. Prize Redemption. A Selected Entrant will be notified by the Promotion Entities via Facebook or Twitter by, specifically, a comment or reply to the Entry and, if possible, a direct message to the Entrant via Facebook or Twitter (the "Contact"). The Contact will be deemed to have been received after twenty-four (24) hours from the time of sending by Organizer. The selected Entrant will then have twenty-four (24) hours to respond by following the instructions provided in the Contact. This form must be completed and returned to the applicable Organizer(s) within two (2) business days of it having been sent. If the Selected Entrant cannot be contacted or fails to timely respond (as defined in these Rules), fails to complete, sign and return the declaration and release form within the time frames stated in this paragraph, he or she will be disqualified and an alternate entrant may, at the sole discretion of the Organizer, be selected in his or her place from among all remaining entries generated during the contest Entry Period. The Promotion Entities are not responsible for late, lost, stolen, delayed, illegible, incomplete, destroyed, misdirected or unsuccessful efforts to notify Selected Entrant. The prize must be accepted as awarded in the name of the Selected Entrant and may not be transferred or assigned prior to pick-up, or exchanged and has no cash surrender value in whole or in part. The Organizer reserves the right to substitute any of the prizes or any portion thereof for a prize of at least equal value in the event of unavailability, or for any reason whatsoever. The Promotion Entities are not responsible if the prize is lost, stolen or mutilated and the prize will not be replaced. The value of the prize may be taxable as income; winners are responsible for any applicable taxes. All taxes, fees, duties and surcharges on the prize and/or the redemption thereof are the sole responsibility of the winner. Selected Entrant must agree to provide required personal information to the Promotion Entities in order to generate tax documents, if required. Selected Entrant (and any guest) must agree to indemnify and hold harmless the Promotion Entities, their employees, clients and agents from and against any liability for such taxes.
8. General. By participating, Entrants agree: (a) they have reviewed, complied, and agreed to be bound by these Rules; (b) to release the Promotion Entities from any and all liability, loss or damage incurred with respect to their participation in this promotion and to the awarding, receipt, possession and use or misuse of a prize; (c) to allow the use of his/her name, city of residence for advertising, publicity and promotional purposes without compensation (unless prohibited by law); and (d) that the Promotion Entities may provide Entrant with promotional materials. Taxes on the prize, if any, are the sole responsibility of winner. The prizes cannot be transferred, assigned or redeemed for cash or substituted except at Organizer’s sole discretion, or as provided herein. All federal, state and local laws and regulations apply.
9. Limitations of Liability. Each Entrant, as a condition of participating, releases and agrees to indemnify and hold harmless Promotion Entities from any and all liability for any injuries, loss or damage of any kind to persons, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize or participation in any Promotion related activity, or participation in this Promotion. The winner shall bear all risk of loss or damage to his/her prize after it has been delivered. Neither the Promotion Entities nor any participating promotion agencies or prize providers are responsible for any incorrect or inaccurate information or for any faulty or failed electronic data transmissions, lost, late, damage, misdirected entries, incomplete or inaccurate capture of entry information (regardless of cause). The Promotion Entities are not responsible for contacting any Entrant if that Entrant has changed contact information and failed to provide the Promotion Entities with the proper contact information when such information is required. If, for any reason, the Promotion is not capable of running as planned for any reason which the Promotion Entities, in their sole opinion, deem could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion and/or these Rules, in whole or in part, and if possible, to select the Selected Entrant from Entries received prior to the action taken or as otherwise may be deemed fair and appropriate by the Promotion Entities. The Promotion Entities reserve the right at their sole discretion to disqualify any Entrant found to be tampering with the entry process or the operation of the Promotion; or to be acting in any manner deemed by Organizers to be in violation of the Rules; or to be acting in any manner deemed by Organizers to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person or interfere in any manner with any aspect or portion of this Promotion. Any use of robotic, automatic, macro, programmed, copied, or like entry methods, will void all such Entries by any methods, and will disqualify any Entrant using such methods. Additionally, the Promotion Entities reserve the right to prosecute any fraudulent activities to the full extent of the law. IN NO EVENT WILL THE PROMOTION ENTITIES BE LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE PROMOTION ENTITIES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Arbitration/Choice of Law. Except where prohibited, Entrants agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or any prizes awarded, or the administration of the Promotion or the determination of winners, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration, to take place in Tennessee pursuant to the Rules of the American Arbitration Association, the effective; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion but in no event attorneys’ fees; and (3) under no circumstance will an Entrant be permitted to obtain awards for punitive, incidental and consequential damages and any other damages (with any such claims waived), other than for actual out-of-pocket expenses. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of Entrants and the Promotion Entities in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of Tennessee without regard to conflicts of law doctrine
