From 1 July, new EPA NSW FOGO (Food Organics & Garden Organics) laws come into effect for many commercial businesses — and if your business produces more than 3m³ of waste weekly (3960 litres combined waste to be exact), food and garden organics can no longer be thrown into your general waste bin.
Instead, these materials must be:
✔ Separated at the source (in your kitchen, restaurant, business, etc.)
✔ Placed into a dedicated organics bin
✔ Collected separately for recycling and diversion from landfill
This applies to restaurants, cafés, clubs, pubs, hospitality venues, supermarkets, shopping centres, and many other commercial businesses.
Businesses that fail to comply with NSW EPA requirements may face compliance action, fines and regulatory penalties of up to $5000 on-the-spot fines, with maximum penalties of up to $500,000 plus $50,000 per day for continuing offences.
