What is the most misunderstood role in ?

Few roles in the construction industry attract more confusion, assumptions and expectations than that of the .

Once a fairly limited role that was confined to assessing claims and resolving minor disputes, the Superintendent is now expected to perform the role of a , , , ’srepresentative, and all around “friend to all - so long as it suits them”.

The reality is, however, that the superintendent is simply what the contract defines the role to be.

Finding a clear explanation of the role in contracts can be a difficult thing. This is because, superintendents often have a ‘dual hat’ role where they have to act as not only as a traditional certifier for assessing payments under a contract – but also as a principal’s agent in assessing other issues under the contract such as , and damages claims.

In this article, Alexander Tuhtan of Shand Taylor Lawyers and Dan Everett of EVERETT Property Development Management explore the modern role of the superintendent and what amendments you should make to your contracts regarding the role of the superintendent.
